THE HYPOCRISY OF AFFIRMATIVE ACTION: RACE AND THE LABOR MARKET

Angela Renee Payne, Bharat S Thakkar

Abstract

This paper presents a critical evaluation of the concept of Affirmative Action: its conceptualization during the Civil Rights Movement, and its enactment with the passage of the Civil Rights Act of 1964. It is argued that upon President Roosevelt’s establishment of the Fair Employment Practice Committee (FEPC) to ensure compliance with Executive Order 8802, which prohibited employment discrimination, based on race, and mandated the use of affirmative action (Executive Order 11246, issued by President Johnson in 1965) in employment, that affirmative action results in hypocrisy in the labor market. This paper questions whether a new narrative for affirmative action toward the rationalization of the Fair Employment Practice would transform issues surrounding race in the labor market.
